A Dhaka court Wednesday sentenced Evaly Managing Director Mohammad Rassel and Chairperson Shamima Nasrin to two years in prison for their involvement in a fraud case.
The verdict was delivered by Metropolitan Magistrate Partha Bhadra, who also imposed a fine of Tk 10,000 on each of the accused. Failure to pay the fines will result in an additional two months of imprisonment.
Both Rassel and Nasrin were absent during the sentencing, prompting the court to issue arrest warrants against them.
According to the case details, Evaly lured customers through its website and Facebook page with flashy advertisements. The plaintiff, Toufiq Mahmud, ordered a Yamaha R15 motorcycle from Evaly on March 20, 2021, paying Tk 2.45 lakh. On April 3 of the same year, he ordered two more bikes for an additional Tk 5.90 lakh. However, Evaly failed to deliver the bikes within the promised 45 days.
When Mahmud contacted Evaly’s Dhanmondi office, the company issued two cheques but advised him not to deposit them due to insufficient funds. Trusting the company, Mahmud refrained from depositing the cheques. Despite repeated requests for a refund of Tk 14.10 lakh, Evaly did not return the money, even after Mahmud sent a legal notice.
As a result, Mahmud filed a case against Rassel and Nasrin on February 4, 2024, leading to the court’s decision.
