A hearing regarding the legality of the 15th Amendment to the Constitution, which abolished the caretaker government system in 2011, is scheduled to take place at the High Court on October 30.
The bench, consisting of Justice Farah Mahbub and Justice Debashish Roy Chowdhury, set the hearing date on Tuesday after a plea from the state. Additional Attorney General Md Arshadur Rouf represented the state during the proceedings.
The 15th Amendment was passed in Parliament on June 30, 2011, and ratified by the president on July 3 of the same year. It not only abolished the caretaker government system but also granted constitutional recognition to Bangabandhu Sheikh Mujibur Rahman as the Father of the Nation.
In addition, the amendment increased the number of reserved seats for women in Parliament from 45 to 50 and reaffirmed the principles of secularism and religious freedom in the Constitution. It also enshrined nationalism, socialism, democracy, and secularism as fundamental state principles.
In August, following the fall of the Awami League government, a writ petition was filed by Shushasoner Jonno Nagorik (SUJAN) Secretary Badiul Alam and four others, seeking to annul the 15th Amendment. The other petitioners include Tofail Ahmed, M Hafizuddin Khan, Jobirul Haque Bhuiyan, and Zahrah Rahman.
On August 19, a High Court bench comprising Justice Naima Haider and Justice Shashank Shekhar Roy issued a rule following the initial hearing, asking why the 15th Amendment should not be declared illegal
