India’s Non-Return of Hasina Would Breach Extradition Treaty: Legal Advisor

Legal Advisor Asif Nazrul claimed that India's failure to extradite the deposed prime minister Sheikh Hasina would constitute a "clear violation" of the extradition treaty between India and Bangladesh.

He added that the foreign ministry would determine the appropriate steps Bangladesh should take in response to such a breach.

Nazrul further clarified that there was "no conflict" between the upcoming national election and the ongoing trial of those "involved in the July-August massacre." He also noted that the law ministry was "quite satisfied" with the pace of the trial proceedings.

Awami League President Hasina fled to India resigning from her premiership on Aug 5 in the wake of a civil uprising.

About 300 cases have been filed against her at different courts across the country on “various charges including genocide" during the quota reform movement and the uprising.

Responding to a question from journalists about bringing Hasina back from India at a briefing at the Secretariat on Tuesday, Nazrul said: "We have written a letter for the extradition. If India does not extradite Sheikh Hasina after the letter, it will be a clear breach of India's extradition treaty with Bangladesh.

“What action we will take in this regard on the global stage will be decided through the foreign ministry."

Stating that a red alert has been issued against Hasina through Interpol, he said: “If there is more to be done, we will think about it."

The advisor said there is no conflict between the election and the trial of those involved in the July-August massacre, adding that the trial process has already begun.

“We had to completely restructure the conventional courts and the International Crimes Tribunal. Appointing prosecutors, investigators, and judges, even renovating buildings – we had to do all the work. The trial is going on at full speed, we are quite satisfied with the speed of the trial.”

"In the next couple of months, you will see frequent hearing dates," he added.

The advisor said there are also plans to set up a second branch of the tribunal to expedite the trial following the appointment of judges to the High Court.
